The Mülheimer Stadtmarketing and Tourismus GmbH (MST), Am Schloß Broich 28, 45479 Mülheim an der Ruhr - hereinafter MST GmbH - is the organizer of public city, Ruhr area and theme tours. The General Terms and Conditions (GTC) for Guided Tours are the basis of the contract between the customer and the organizer MST GmbH for contracts concluded from 01.07.2018.
1. Booking / contract
1.1 a) public guided tours
The booking of public city tours of the MST GmbH can be made in writing, by e-mail, by fax or orally. With the payment of the ticket (s) the contract with the MST GmbH is concluded.
1.2 b) individual group bookings
Individual guided tours for groups via the MST GmbH can be made in writing, by e-mail, by fax or orally. The customer will be sent an offer listing the service provided by MST GmbH. With the written or telephone confirmation of the customer, the contract is concluded.
1.3 If, for the purpose of the same trip, the guest books at least one other travel service (eg. accommodation) via the MST GmbH at the same time as the guest tour / city, Ruhr or theme tour, and these two services are selected and paid for separately, there is an affiliated travel service according to § 651w BGB. In these cases, MST GmbH informs the guest in accordance with Art. 251 EGBGB; in particular, it shall provide him with a corresponding completed form pursuant to Art. 251 § 2 EGBGB. In addition, MST GmbH will prove to the guest the conclusion of a customer deposit insurance contract. This is done by handing over a corresponding security note.
1.4 In cases other than those in para. 1.3 regulated there is a package holiday when booking together and paying for several different travel services. Then, instead of these terms and conditions for guided tours, the General Terms and Conditions for package offers of MST GmbH apply.
1.5 The no. 1.3 and 1.4 do not apply if the touristic service (guided tour / city, Ruhr or theme tour) does not make a significant contribution to the total value of the compilation (eg. less than 25% of the total value) and the tourist services when booking several different types of travel services neither constitute an essential feature of the compilation nor be advertised as such or selected and agreed until after commencement of the provision of the alternative travel service.
1.6 The point. 1.3 and 1.4 continue not to apply to travel contracts that
a) be offered only occasionally, not for the purpose of making a profit and only to a limited number of persons,
b) less than 24 hours and do not include overnight stay (day trip) and whose travel price does not exceed 500 euros or
c) on the basis of a framework contract for the organization of business trips with a traveler who is an entrepreneur for whose entrepreneurial purposes the contract is concluded.
2. Resignation by the customer
a) public guided tours
Tickets for public tours are excluded from return and exchange.
b) Group bookings
The customer can withdraw at any time before the start of the tour. MST GmbH is entitled to demand compensation for the arrangements made and for their expenses. The cancellation of a booked service must be in writing, by e-mail, fax or telephone. Decisive is the receipt of the cancellation at the MST GmbH.
The following cancellation fees apply
up to 30 days before date 15% of the price
29 - 14 days before date 25% of the price
13 - 7 days before date 40% of the price
6 - 3 days before date 60% of the price
from the 3rd day before the appointment or in case of non-appearance of the group 80% of the price
If the group is delayed, our tour guides will wait 30 minutes. In the case of foreseeable delay, we ask for immediate notification. Otherwise, if the group arrives late, the duration of the tour will be shortened accordingly, or otherwise the overdrawn time will be charged.
3. Resignation by the organizer
MST GmbH reserves the right to withdraw from the contract if it is unable to carry out the guided tours and city, Ruhr and theme tours for a reason beyond its control (force majeure, strike or natural disasters) or if the guest is in default with his performance or otherwise violated his contractual obligations to such an extent that MST GmbH can no longer be expected to continue the contract.
MST GmbH will inform the customer of the obstacle immediately. The customer will be refunded immediately the contract amount already paid. Claims for damages resulting from the resignation of the customer are excluded.
4. Liability
The operator has no claim for damages against the organizer due to the breach of contractual obligations, unless the organizer or his vicarious agents have caused the damage intentionally or through gross negligence. Claims for damages due to injury to life, body or health remain unaffected by the disclaimer.

We ask you to read the following terms and conditions carefully. These General Terms and Conditions apply exclusively to contracts or bookings from 01.07.2018. With the booking of a package offer from 01.07.2018 with us you accept these conditions.
1) Conclusion of the travel contract / information duties
1.1 With your registration, which can be made in writing, verbally, by telephone or by email, you offer MST GmbH the conclusion of a travel contract based on our travel contract binding.
1.2 The contract is concluded exclusively through the receipt of a written booking confirmation. This does not apply to bookings made less than 7 business days prior to departure. Here, a telephone booking confirmation, or by email, also leads to a binding contract.
1.3 The applicant is liable for all obligations of co-registered travel participants from the travel contract, provided that he has accepted these obligations by an express, separate written declaration.
1.4 If the content of the travel confirmation differs from the content of the registration, then there is a new offer of the MST GmbH, to which it is bound for a period of 10 days. The contract is concluded on the basis of this new offer if the guest accepts this amended offer within the deadline.
1.5 The MST GmbH informs the guest before submitting his contract declaration in accordance with Art. 250 §§ 1 to 3 EGBGB; In particular, it provides him with a form completed in accordance with Art. 250 § 2 EGBGB.
1.6 The MST GmbH shall provide the guest with a copy or confirmation of the contract at or immediately after the conclusion of the contract in accordance with Art. 250 § 6 EGBGB. In addition, in accordance with Art. 250 § 7 EGBGB, it will provide the guest with the necessary travel documents in due time before departure.
2) Payment
2.1 Payments on the travel price before the end of the journey may only be demanded or accepted if there is an effective customer money security contract within the meaning of § 651r BGB and the traveler clearly, understandably and in a prominent way the name and contact details of the customer money protection provided. This is done by handing over a corresponding security note.
2.2 para. 2.1 does not apply to travel contracts that
a) be offered only occasionally, not for the purpose of making a profit and only to a limited number of persons,
b) less than 24 hours and do not include overnight stay (day trip) and whose travel price does not exceed 500 euros or
c) on the basis of a framework contract for the organization of business trips with a traveler who is an entrepreneur for whose entrepreneurial purposes the contract is concluded.
2.3 At the time of booking a down payment of 20% of the travel price is due. The remaining payment to the MST GmbH takes place until 21 days before the date of travel. The right of the guest to withhold a disputed price increase demanded after conclusion of the contract remains unaffected.
3. Modifications
MST GmbH reserves the right to unilaterally change the terms of the contract other than the travel price, provided the change is insignificant. The MST GmbH informs the guest about a change before departure.
Any warranty claims remain unaffected, as far as the changed services are flawed.
4. Resignation by the guest
4.1 The guest can withdraw from the trip at any time prior to departure. Decisive is the receipt of the declaration of resignation at the MST GmbH. The guest is recommended to explain the withdrawal in writing.
4.2 The following, lump-sum cancellation rate in the percentage relation to the travel price makes the MST GmbH with resignation:
up to 30 days before departure 5%
from 29th-21st Day before departure 20%
from 20th-14th Day before departure 35%
from 13th-7th Day before departure 50%
from the 7th to the 1st day before departure 70%
4.3 The guest is expressly permitted to prove that the claim for compensation has not been made or that the compensation is substantially lower than the flat rate stated.
4.4 Contrary to 4.2, MST GmbH cannot claim compensation if unavoidable, exceptional circumstances occur at or near the place of destination that significantly affect the performance of the package holiday or the transport of persons to the destination. Circumstances are unavoidable and exceptional in the sense of these General Conditions of Travel if they are not under the control of the party relying on them and could not have avoided their consequences even if all reasonable precautions had been taken.
5. Unused services
If the guest does not make use of individual travel services as a result of premature return travel or other compelling reasons, MST GmbH will endeavor to reimburse the service providers for the saved expenses. This obligation does not apply if the services are completely insignificant or if a refund conflicts with legal or regulatory requirements
6. Resignation and termination by the MST GmbH
6.1 MST GmbH may withdraw from the contract prior to departure if:
(a) fewer persons have registered for the package holiday than the minimum number of participants specified in the contract; in this case the MST GmbH has the resignation at the latest
aa) 20 days before the start of the journey for a travel duration of more than six days,
bb) seven days before the start of the journey for a minimum of two and a maximum of six days,
cc) 48 hours prior to departure for a journey of less than two days
to explain,
b) MST GmbH is prevented from fulfilling the contract due to unavoidable, extraordinary circumstances; In this case, she must declare the resignation immediately after knowledge of the reason for withdrawal.
6.2 MST GmbH may terminate the travel contract in accordance with § 314 BGB for good cause without notice after commencement of the journey. An important reason exists in particular if the guest disturbs the execution of the trip in spite of a warning from the MST GmbH or its agents lastingly or if he behaves contrary to the contract to such an extent that the immediate cancellation of the contract is justified. If the MST GmbH terminates, it reserves the right to the travel price; however, it must recognize the value of the expenses saved and any benefits it derives from any other use of the unused service, including any sums credited to it by the service providers.
7. Limitation of liability of MST GmbH
The contractual liability of MST GmbH is limited to three times the travel price for such damages
a) are no physical injuries and
b) are not culpably caused.
8. Guarantee, termination by the guest, obligation to notify
8.1 If the trip is defective, the guest may request a remedy. MST GmbH may refuse to remedy the situation if it is impossible or disproportionately expensive, taking into account the extent of the travel shortage and the value of the travel service concerned. Subject to these exceptions, if MST GmbH does not remedy the situation within a reasonable period determined by the traveler, the traveler can remedy the situation himself and demand compensation for the necessary expenses. The determination of a deadline is not required if the remedy is denied by the MST GmbH or if immediate remedy is necessary. Can MST GmbH correct the travel shortage according to para. 8.1 S. 2 refuse and concerns the lack of travel a considerable part of the travel services, the MST GmbH has to offer remedy by appropriate compensation.
8.2 For the duration of the travel shortage, the travel price is reduced. In the case of the reduction, the price of the journey must be reduced in the ratio in which the value of the journey in immaculate condition at the time of the conclusion of the contract would have been the real value.
8.3 If a journey is significantly impaired as a result of a defect and MST GmbH does not remedy the situation within a reasonable period of time, the guest may terminate the travel contract within the scope of the statutory provisions - in his own interest and for reasons of evidence by written declaration; Para. 8.1 p. 4 applies accordingly. If the contract is terminated, the MST GmbH reserves the right to the agreed travel price with regard to the travel services (eg return transport) to be provided for the purpose of ending the journey, as provided for in § 651l (3) BGB.
8.4 The guest may demand damages without prejudice to the reduction or the termination, unless the lack of travel
a) is the fault of the guest,
b) is the fault of a third party who is neither a service provider nor otherwise involved in the provision of the travel service covered by the travel contract, and was unforeseeable or unavoidable for MST GmbH or
c) was caused by unavoidable, extraordinary circumstances.
8.5 The guest must notify MST GmbH of a travel shortage without delay. Insofar as MST GmbH was unable to remedy the situation as a result of a culpable omission of the advertisement, the guest is not entitled to claim reduction or compensation for damages.
9. Statute of limitations
The in no. 8 designated claims of the guest become statute-barred within two years. The statute of limitations begins with the day on which the journey should end the contract.
Another important note for our guests:
We recommend the conclusion of travel cancellation insurance and insurance to cover the costs of repatriation in the event of accident or illness, e.g. by the insurer "ERV Europäische Reiseversicherung AG".
